The Canadian Home Builders' Association of British Columbia (CHBA BC) has learned that a legal opinion has found a Canada Post initiative unlawful.

Late last year, Canada Post announced that, starting January 1, 2013, it will charge a one-time fee of $200 per address for the set up of community mailboxes (CMBs).

The Urban Development Institute (UDI) of Alberta and CHBA Alberta commissioned a legal opinion about this fee, and that legal opinion found that:

    •    The imposition of the $200 community mailbox (CMB) setup fee sought to be imposed by Canada Post against developers is unlawful in its present form.
    •    Canada Post cannot force Alberta municipalities to include CMB-friendly provisions in development or servicing agreements
    •    Any attempt by an Alberta municipality to force a developer into a CMB set-up fee agreement with Canada Post would be unlawful
